Arrest Made in Traffic Fatality: 1st Street and South Capitol Street, SW

Detectives from the Metropolitan Police Department’s Major Crash Unit announced the driver of a vehicle has been arrested in connection with a pedestrian fatality, which resulted from a traffic collision at 1st Street & South Capitol Street, SW.

On Sunday, April 28, 2013, units from the Seventh District responded to a pedestrian traffic collision with injury. At approximately 2:45 pm a white 2010 Toyota Yaris was traveling northeast bound on First Street, SW approaching South Capitol Street, SW, at which time the driver attempted to execute a right turn to proceed southbound on South Capitol Street, SW.  The vehicle narrowly missed colliding with a southbound vehicle that was traveling on South Capitol Street on the green light.  The driver of the Toyota lost control of the vehicle and mounted the west curb.  At that time, the pedestrian was walking south on South Capitol Street on the west side sidewalk. The Toyota struck the pedestrian pinning her against a tree.

The pedestrian sustained massive blunt impact injuries that were incompatible with life and she remained on the scene.  The decedent was transported to the Office of the Chief Medical Examiner.

The decedent has been identified as 58-year-old Emmajean Gainey of Southwest, Washington, DC.

The driver of the Toyota has been identified as 49-year-old Maria Nicole Werts of Southwest, DC. She was arrested and charged with Involuntary Manslaughter and Driving While Intoxicated in the death of Emmajean Gainey.

The Metropolitan Police Department’s Major Crash Unit is investigating this crash.
