Declaration Establishing a Prostitution Free Zone

WHEREAS;
D.C. Act 16-445, the "Omnibus Public Safety Emergency Amendment Act of 2006," was enacted July 19, 2006. 

WHEREAS;

            The Omnibus Public Safety Emergency Amendment Act of 2006 (hereafter, "the Act") provides, among other things, that the Chief of Police may declare any public area a Prostitution Free Zone for a period not to exceed 240 consecutive hours, based on the following considerations:

           

            "The occurrence of disproportionately high arrests for prostitution or prostitution-related offenses, and calls for police service because of prostitution or prostitution-related offenses in the proposed prostitution free zone within the preceding 6-month period;

            Objective evidence or verifiable information that shows that a disproportionately high incidence of prostitution or prostitution-related offenses are occurring on public space or public property within the proposed prostitution free zone; and

            Any other verifiable information from which the Chief of Police may ascertain whether the public health or safety is endangered by prostitution or prostitution-related offenses in the prostitution free zone."  (? 104(b)(2))

WHEREAS;

         

The Metropolitan Police Department has issued appropriate directives (Special Order 06-14) to its members describing the requirements of the Act and providing operational guidelines for enforcing the Act.

WHEREAS;

           

Information pertaining to the above-listed considerations has been supplied to me by the Commander of the police district within which the following area is situated, and further information of the same nature is available to me from reliable sources, including, among other things, confidential police investigative reports.

 

NOW THEREFORE;

            I hereby determine and declare that the following described area shall be designated as a Prostitution Free Zone and that the respective police commander shall take all steps necessary to enforce the provisions of the Act in accordance with all applicable directives and operational guidelines of the Metropolitan Police Department:

PROSTITUTION FREE ZONE ESTABLISHED

Boundaries of Prostitution Free Zone:

Starting at the northwest corner of the zone at the intersection of the western edge of the sidewalk of 59th St NE and the northern edge of the sidewalk of Field PI, NE, proceed east along the northern edge of the sidewalk of Field PI, NE. At the intersection of the northern edge of the sidewalk of Field PI, NE and the southern edge of the sidewalk of Eastern Ave, NE, proceed southeast along the southern edge of the sidewalk of Eastern Ave, NE. At the intersection of the southern edge of the sidewalk of Eastern Ave, NE and the sidewalk edge of 62nd Ave, NE, proceed northwest to the northern edge of the sidewalk of 61 st St, NE. At the northern edge of the sidewalk of 61 st St, NE, proceed southwest to the northern edge of the sidewalk of Eads St, NE. At the intersection of the northern edge of the sidewalk of 61st St, NE and the northern edge of the sidewalk of Eads St, NE, proceed west along the northern edge of the sidewalk of Eads St, NE. At the intersection of the northern edge of the sidewalk of Eads St, NE and the western edge of the sidewalk of 59th St, NE, proceed north, finally returning to the starting point.
 
Effective Dates and Times
 
This Prostitution Free Zone shall be enforced beginning at 0001 hours (12:01 A.M.) on Thursday, October 27, 2011, and concluding at 0000 hours (12:00 A.M.) on Monday, October 31, 2011.  

District Commander:        

            By memorandum of September 28, 2011, Commander Robert Contee, commanding officer, Sixth District, Metropolitan Police Department, submitted a request for declaration of a Prostitution Free Zone in the area described above.  The memorandum, including a sketch of the boundaries of the Prostitution Free Zone, is incorporated by reference as a part of this Declaration.
